These Terms of Service (“Terms”) govern your participation in the Avira Blog Name Contest. By sending an email to the mail-address as required for participation in the contest, you agree to this Statement and the following terms.
- Participation and Eligibility
To participate in this contest, you must have the deepest commitment, the most serious mind. Submit one or more entries to the contest by sending an email to the following address you must: email@example.com. The entry must meet the contest requirements as outlines in these terms. A high council will assess all entries and decide on the three best entries and the winning entry. Each of the three winning entries will be awarded one one year license for Avira Antivirus Pro and one Avira t-shirt and one as a reward. Winners will be notified through a disturbance in the force or by email and will have to provide us with all necessary details to award the prices.
You warrant that any entry is your original creation and that your entry will not infringe upon the Intellectual Property Rights of other parties. By submitting your entry, you are giving Avira Operations GmbH & Co. KG a perpetual, non-exclusive, royalty-free, world-wide license to display your entry as well as publicly distribute it in our products and on our website. We are free to – but are under no obligation to use your entry in any way. Winning of the contest and awarding of the prizes is conditional upon meeting all the requirements as stated in these terms and being chosen by the jury. No purchase is necessary to enter.
The contest is open only to those who are at least 16 years of age at the date of submitting the contest entry. Those who have not attained the age of majority in their jurisdictions must have their parent’s or legal guardian’s consent to enter into contests. The contest is subject to all applicable laws and regulations and void where prohibited.
You participation requires that you commit to and your entries must comply with the following:
- You will not send or otherwise post unauthorized commercial communications (such as spam)
- You will not send viruses or other malicious code.
- Your entry may not be hateful, threatening, racist, discriminatory, defamatory or pornographic; incite violence; contain nudity or graphic or gratuitous violence.
- Your entry must be your own idea and a new name, which has not previously been used for a product similar to the Avira Blog.
- In participating, we expect you to respect other people’s rights.
- Your entry may not infringe or violate someone else’s rights or otherwise violate the law.
- We can reject any entry and exclude it from the contest if we believe that it violates this statement.
- Intellectual Property
By entering into this contest and submitting an entry, you agree that you assign to Avira Operations GmbH & Co.KG, all Intellectual Property Rights which you have or may in the future have in the contest entries you post. You grant us a perpetual, royalty-free, unlimited, sub-licensable and assignable license to the content of your entry. You indemnify us against any loss, cost, expense or damage (including legal costs) which we may suffer or incur as a result of your breach of any of the provisions of these terms.
- Personal Data
While participating in the contest, you may need to submit personal information like your email address, your name, your address or similar details. We will exclusively use this information to process your submission to the contest, to select the winners and to award the prices. We will not intentionally sell, share, or distribute your personal information to third parties, except as required by law.
- Organizing entity and applicable laws
The organizing entity and your contractual partner in this contest is Avira Operations GmbH & Co.KG, Kaplaneiweg 1, 88069 Tettnang, Germany and the contest and your participation shall be exclusively subject to German Laws.
